What Is an Immigration Bond?
An immigration bond is an amount of money set by the ICE that the detained individual must pay in order to be released from detention. The release is based on an implied agreement that the bonded individual will attend his or her court hearings, and the bond amount acts as a guarantee of the agreement. This means that if the bonded individual attends all required legal proceedings, he or she will receive that bond money back. However, if he or she flees or fails to attend, the money will be lost.
Am I Eligible for Bond?
In most cases, you should be eligible for bond. However, detained foreign nationals must submit to mandatory detention if they have committed certain serious crimes, and will not be eligible for release on bond.
If you have been convicted of any of the following crimes, you will not be eligible for an immigration bond:
- Aggravated felony
- Crimes of moral turpitude, which are defined loosely, but typically refer to murder, rape, spousal or child abuse, kidnapping, robbery, and other similar crimes.
- Suspected of terrorism
- Possession of controlled substances (excepting 30 grams or less of marijuana)
