Do I Qualify for an L1A or L1B Visa?
If you fit any of these descriptions, you are eligible to apply for the L1A visa:
- You are the manager of some aspect in the organization that is transferring you
- You are a supervisor to other employees or manage necessary operations within the organization
- Your position grants you the authority to hire, fire, and recommend promotions. If those roles are not applicable, you must be at the senior level within the company.
- You have a management or leadership role that involves directing daily operations
You are eligible for the L1B visa if you have special or unique knowledge regarding any of the essential aspects of the company’s work. This could include expertise in how the company works operationally, or it could be special knowledge regarding some service, product, technology, equipment, etc. This visa is reserved for “key” employees who are considered absolutely vital.
Being a high-performing employee is not enough, even if you are more skilled than the average worker. In order to qualify for this visa, you must demonstrate that no other person could be trained to do your job without causing great economic inconvenience for the organization. Examples include employees who have specialized knowledge of the company’s proprietary software or products, or individuals involved in specialized research for the company.

An L1-A visa grants the visitor 7 years in the U.S and the L1B grants 5 years. If you were initially granted the L1B visa for possessing special knowledge, but are now eligible for the L1A visa because you are a company manager, you may apply to switch your status after you have spent 4.5 years in the U.S. under the L1B visa.
