Am I eligible for TN nonimmigrant status?

The following conditions must be true in order to qualify as a NAFTA professional:

  • You are a citizen of Canada or Mexico
  • Your profession is on NAFTA’s pre-approved list, which is extensive, but includes scientists, healthcare providers and medical professionals, teachers, lawyers, architects, engineers, and more.
  • A company in the U.S. needs you and has pre-arranged a part-time or full-time position for you. (Self-employment is not eligible)
  • You meet the position’s qualifications, whether related to education level or experience. In most cases, a baccalaureate degree is required, with some exceptions.

An important difference between the requirements for Canadian and Mexican citizens is that Canadian citizens do not need the TN visa, while Mexican citizens do. In other words, a Canadian citizen can be granted TN nonimmigrant status without also obtaining the TN visa. A Canadian citizen would only need the visa if he or she lives in a third country with his or her family and wants to bring them to the U.S. as well. Mexican citizens, however, are required to obtain the TN visa in order to be granted TN nonimmigrant status.
